Dems Rightly Set to Fillibuster Gorsuch
I’m glad to see they’ve ignored the media meme that they have to ‘not forfeit the moral high ground’ and should hold their powder for the next Trump nominee.
Sorry but that’s not how it works. First of all, you never know wether there’s a ‘next time’ or not. Maybe-hopefully-Ruth Bader Ginsburg holds on till 2020. But the idea that some moderate Democrats reportedly had at one point that they should ask the GOP to let them filibuster the next pick was just absurd.
We won’t filibuster Gorsuch if you promise not to be mad at us for filibustering the next SCOTUS pick.
As if Mitch McConnell would make that promise and as if it’d be worth anything if he did.

I’m happy to see that Claire McCaskill is a no.
“Moderate Missouri Sen. Claire McCaskill will vote to filibuster Neil Gorsuch, becoming the 36th Democratic senator to vow to block President Donald Trump’s Supreme Court nominee from confirmation.”
“McCaskill’s announcement Friday pushes the Senate ever-closer to a major confrontation next week over the chamber’s rules. If Democrats can secure five more votes to deny Gorsuch the 60 votes he needs to advance, Senate Majority Leader Mitch McConnell (R-Ky.) is likely to gut the supermajority requirement on Supreme Court nominees using the “nuclear option.”
“Republicans had hoped people like McCaskill, who is up for reelection in a conservative state next year, would come around to supporting Gorsuch given her state’s backing for Trump. And McCaskill privately fretted at a fundraiser last week that blocking Gorsuch would have dire implications for Democrats if McConnell changes the rules and another Supreme Court vacancy opens up with Trump as president.”
“But ultimately McCaskill concluded that she “cannot support Judge Gorsuch because a study of his opinions reveal a rigid ideology that always puts the little guy under the boot of corporations.”
She’s made the right choice. Honestly, what’s the use of a filibuster you can never use? Big picture, it also means when the Dems have the WH and Senate back, no more GOP filibuster. So it equals out.
Liberals are ignoring the worrywarts:
“Liberals taste victory no matter Gorsuch outcome.”
“Activists demanded a filibuster and it looks like they’ll get one.”
“After weeks of publicly complaining that Senate Democrats were going easy on Neil Gorsuch, liberal activists are close to securing a successful filibuster of President Donald Trump’s Supreme Court pick. But they’re not stopping there.”
“Activists are now vowing to make Republicans pay a political price if they decide to rip up Senate rules to push Gorsuch through with a simple majority vote. And if Majority Leader Mitch McConnell does kill the Supreme Court filibuster to confirm Gorsuch, liberals say they’ll still come out on top — having further emboldened a base that wants Democrats to brook no compromise with Trump.”
“Democrats showing they can unify [against Gorsuch] helps energize the grass roots,” MoveOn.org Washington director Ben Wikler said in an interview. “If Republicans decide to go nuclear, that will further energize the resistance movement. The only bad path here is for Democrats to flee the fight.”
“Simply getting to this point is a victory for the left, which began the Supreme Court battle frustrated with Senate Democrats and bluntly urging them to “do better” as Gorsuch appeared on track for easy confirmation. But over the past two weeks, as liberals kept nudging Senate Minority Leader Chuck Schumer’s caucus to push back harder, Democrats have abandoned their reluctance to commit to a filibuster.”
Again, it’s not costless for the GOP to go nuclear. As for asking the Dems to ‘Hold the moral high ground’-that’s not how this works. If the GOP continues to step on norms, the Dems can’t protect these norms by rewarding the GOP.
Only when there is a cost for norm breaking will the GOP stop.
The reason for filibustering are clear:
1. Merrick Garland. This is a stolen seat and the Dems must not reward the GOP for this breach of norms.
2. With the Russia probe, we don’t even know if Trump colluded with a hostile foreign power to win the election. Until we do, as Ted Lieu (D-CA) argues there shouldn’t be regular order.
